Indemnity & Damages Agreement

Part of every Dimple's Joy order. Accepted and signed electronically by the hirer when booking. Version 2026-10-22.

Jumping castles involve physical activity, and bumps, falls and injuries can happen. Use of all equipment is at your own risk.

1. Use at your own risk

The hirer, the hirer's family, guests and every child or adult who uses the equipment do so entirely at their own risk.
To the fullest extent the law allows, Dimple's Joy and My African Dream (Pty) Ltd, its directors, staff, caretakers and contractors are not responsible for any injury, illness, disability or death, or for any loss of, theft of or damage to property, however it happens, during delivery, set-up, use, overnight keeping or collection of the equipment.
This does not exclude liability for harm caused by the gross negligence of Dimple's Joy or its staff, where the law does not allow that to be excluded.

The hirer indemnifies and holds harmless Dimple's Joy and My African Dream (Pty) Ltd against any claim, demand, legal cost or liability made by the hirer, the hirer's family, guests, children or anyone else, arising from the hire or use of the equipment.
The hirer accepts this agreement for themselves, their family and every child in their care at the event, and will make sure the parents or guardians of children attending know that use is at their own risk.

Children must be supervised by a responsible adult at all times. A booked Dimple's Joy caretaker helps supervise the children on the castles; parents, guardians and the hirer remain responsible for their children.
No shoes, glasses, sharp objects, food, drink, sweets or chewing gum on the castles. No flips, somersaults, climbing or hanging on the walls.
Group children by age and size and do not overload a castle. Adults may not use castles meant for children.
No smoking, fires or braais near the equipment. Stop using the castles in strong wind, rain or lightning, and whenever the blower is off.
Do not move the equipment or the blower once it is set up. The hirer provides a safe, level site, access for delivery and collection, and a working power point for the blower.

From delivery until collection the equipment is in the hirer's care and at the hirer's risk, including overnight.
The hirer is liable for any loss, theft or damage other than normal wear and tear, including damage caused by guests, children, pets, misuse, fire, sharp objects, vandalism, or weather where the equipment was not protected as instructed.
VIP toilet trailer: use it only as a toilet. No nappies, sanitary products, wipes or other objects in the toilets. Blockages and damage from misuse are chargeable.
Dimple's Joy has the right to claim from the hirer the full cost of repair, extra cleaning or replacement, and any reasonable cost of recovering it. Claims are invoiced with photos and the repair quote or replacement cost, and are payable on receipt of the invoice.

The hirer provides a reliable electricity supply at the venue. Dimple's Joy is not responsible for load shedding, outages, unreliable supply or any other power problem on site.
One 50 m extension lead is included. The hirer declares the distance from the nearest power outlet when booking; extra leads are charged, and Dimple's Joy may refuse to run power further than it considers safe.
Castles cannot be powered or used in the rain. Rain, storms, strong wind, load shedding and power failures are force majeure events outside Dimple's Joy's control. Because transport costs are incurred, no refunds are given for these events.

Your personal information is used only to manage your booking, payment, delivery and any claim, and is kept securely in line with POPIA.
Dimple's Joy does not photograph children, or use photos of children, without a parent's or guardian's consent.

This Indemnity & Damages Agreement forms part of your order, together with the terms and conditions.
By ticking the box and typing your full name you sign it electronically, and confirm that you are 18 or older, have read and understood it, and accept it for yourself and the people you are responsible for. Your name, the date and time, and your device's IP address are recorded with your booking.
